Terms and Conditions

These Terms and Conditions set forth the rules, rights, and obligations applicable to individuals purchasing tickets for the Flat Out Days MTB Festival (hereinafter referred to as "the Festival") organized by BATT CREW d.o.o (hereinafter "the Organizer").

1. Ticket Purchase

Important: Only purchase tickets from authorized outlets (the official festival website: www.flatoutdays.com). Attempting to gain entry with a counterfeit ticket will result in prosecution. By using this ticket, you acknowledge that you have read and accepted the rules posted on the festival website. Failure to adhere to these rules may result in removal from the venue and potential legal action.

2. Ticket Validity

Each ticket is valid for one entry to the Festival. Once scanned, the ticket is no longer valid for re-entry unless exchanged for a wristband. You can transfer your ticket to another person by changing the name on the ticket. To do so you must contact the organizer at least 14 days before the festival to request name transfer. If you cannot attend the current festival, you can transfer your ticket to the next Flat Out Days Festival. However, if ticket prices have increased for the subsequent event, you will need to pay the price difference. To do so you must contact the organizer at least 14 days before the festival to request date transfer. Tickets are non-refundable.

3. Entry Conditions

Entry is subject to security checks. The Organizer reserves the right to refuse entry or eject from the venue anyone behaving inappropriately or endangering the safety of others. Children under a certain age may require adult accompaniment; please check the festival website for details.

4. Event Changes or Cancellations

The Organizer may alter the event schedule, lineup, or even cancel the event due to unforeseen circumstances including but not limited to acts of God, governmental restrictions, or safety concerns. In case of cancellation, refunds will be processed as per legal requirements and the Organizer's policy. Changes will be communicated via www.flatoutdays.com and our official social media channels. The event will proceed rain or shine. In case of thunder storms the chair-lift infrastructure has to stop operations.

5. Refund Policy

No refunds are available for changes to the event schedule, except as provided by law. In case of event cancellation, tickets can be refunded within 30 days at the point of purchase, subject to the seller's rules.

6. Behavior Rules

Attendees must adhere to all local laws, venue rules, and these terms. Prohibited behaviors include but are not limited to violence, theft, or the use of illegal substances. Attendees agree to respect the environment, facilities, and other festival-goers.

7. Consent for Recording

By entering the Festival, you consent to being photographed, filmed, or recorded. These recordings may be used for promotional or commercial purposes by the Organizer or its partners.

8. Liability

The Organizer is not liable for personal injury or property damage unless due to negligence by the Organizer or its agents. Attendees enter at their own risk, acknowledging potential hazards inherent to outdoor events.

9. Governing Law

These terms are governed by Slovenian law, and any disputes will be subject to the jurisdiction of Slovenian courts.

10. Amendments

The Organizer reserves the right to update these terms. Changes will be posted on the website, and your continued use of the ticket implies acceptance of the new terms.

11. Event Interruptions and Refunds

If the event is interrupted or not held due to reasons such as power cuts, adverse weather, external factors, epidemics, pandemics, or force majeure ("reasons for interruption"), ticket holders will not be entitled to a refund, ticket exchange, or any other compensation.

12. Assumption of Risk and Liability

The ticket holder assumes all risks of injury and responsibility for property loss, destruction, or theft. Promoters, performers, sponsors, venue operators, and ticket outlets, along with their employees, are released from any liability, except for personal injury or death caused by negligence or fraudulent acts.

13. Security and Prohibited Items

All attendees are subject to a search upon entry, in accordance with the law. If offensive materials are found, or if an attendee refuses to consent to a search, they will be denied entry. Recording a performer’s performance without prior written consent is prohibited. The use of professional cameras or recording equipment is not allowed.

14. Event Conditions

Tickets cannot be used for promotional purposes without the Organizer’s permission and may not be resold for more than their face value.
